You are not being sued. The class action lawsuit alleges that Hotel Companies failed to inform guests sufficiently about the Resort Fee that certain Resorts imposed. The amount of the Resort Fee varied by resort and over time, and the services and facilities covered by the fee also varied by resort; and, for purposes of the proposed Settlement, the amount of the Resort Fee has ranged on average from $7.50 to $20.00. The lawsuits allege that the Hotel Companies breached the contract with guests and engaged in unfair and deceptive business practices by not providing adequate notice of and information about the Resort Fee. The Hotel Companies deny each and every allegation and believe that they have strong factual and legal defenses to the claims. Lead Class Counsel has informed the Court that, after a thorough investigation and analysis of the facts and the law and after consideration of (1) the substantial and certain benefits provided by the Settlement and (2) the risks and delays of class action litigation, the Class Representative and Lead Class Counsel have reached a Settlement with Hotel Companies that they believe is fair, reasonable, and adequate, is in the best interests of the Class, and fairly resolves the claims alleged. The Court has preliminarily approved the proposed Settlement of this class action. On January 16, 2007, the Court will hold a Final Approval Hearing to determine whether to finally approve the Settlement.
